    5. This Treaty shall be open for signature at the FAO from 3 November 2001 to 4 November 2002 by all Members of the FAO and any States that are not Members of the FAO but are Members of the United Nations, or any of its specialised agencies or of the International Atomic Energy Agency.
    6. stressing the need to strengthen the role of the United Nations Security Council, as final arbiter, in order that it can take appropriate action in the event of non-compliance with NPT obligations, in keeping with the Statute of the International Atomic Energy Agency (IAEA), including the application of safeguards;
    7. This Treaty shall be open for accession by all Members of the FAO and any States that are not Members of the FAO but are Members of the United Nations, or any of its specialised agencies or of the International Atomic Energy Agency from the date on which the Treaty is closed for signature.
    8. The European Agency for Reconstruction implements Community assistance provided for in Regulation (EC) No 2666/2000 [2] in Serbia and Montenegro, including Kosovo as defined by United Nations Security Council Resolution 1244 of 10 June 1999, and in the former Yugoslav Republic of Macedonia.
    9. As far as necessary for the realisation of their actions on the basis of Article 9(5) and 11(2) of Regulation (EC) No 2152/2003, access to the data referred to in Articles 4(1) and 5(1) of that Regulation shall be granted to the European Environmental Agency and the International Co-operative Programme on Assessment and Monitoring of Air Pollution Effects on Forests operating under the United Nations Economic Commission for Europe, (ICP Forests).
    10. Community assistance provided for in Council Regulation (EC) No 2666/2000 of 5 December 2000 on assistance for Albania, Bosnia and Herzegovina, Croatia, the Federal Republic of Yugoslavia and the former Yugoslav Republic of Macedonia, repealing Regulation (EC) No 1628/96 and amending Regulations (EEC) No 3906/89 and (EEC) No 1360/90 and Decisions 97/256/EC and 1999/311/EC [2] (the CARDS programme) is implemented in Serbia and Montenegro, including Kosovo as defined by United Nations Security Council Resolution 1244 of 10 June 1999, and in the former Yugoslav Republic of Macedonia by the European Agency for Reconstruction established by Council Regulation (EC) No 2667/2000 [3].
    11. For each Member of the FAO and any State that is not a Member of the FAO but is a Member of the United Nations, or any of its specialised agencies or of the International Atomic Energy Agency that ratifies, accepts, approves or accedes to this Treaty after the deposit, in accordance with Article 28.1, of the 40th instrument of ratification, acceptance, approval or accession, the Treaty shall enter into force on the 90th day following the deposit of its instrument of ratification, acceptance, approval or accession.
